Welcome to Chipmunk Studio! These Terms of Use (“Terms”) govern your use of our mobile applications (“App”) available on the App Store. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Use of the App

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you may only use the App with parental or guardian consent. You agree to use the App only for lawful purposes and in compliance with all applicable laws. You may not reverse engineer, modify, distribute, or reproduce the App without our prior written consent.

User Accounts & Data

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials. By using the App, you agree that your data may be collected and processed in accordance with our Privacy Policy.

AI and Third-Party Services

Our App may integrate AI services, including OpenAI or other providers, to enhance user interactions. The use of AI-generated responses is for informational purposes only, and we do not guarantee their accuracy. By using the AI features, you acknowledge that your interactions may be processed by third-party AI service providers, as outlined in our Privacy Policy.

In-App Purchases and Subscriptions

Some features of the App may require payment:

• Purchases and subscriptions are processed through the App Store, and their terms apply.
• Subscription fees are billed periodically and will renew automatically unless canceled in your App Store settings.
• Refund requests must be handled directly through the App Store.

Intellectual Property

All content, trademarks, and intellectual property related to the App belong to Chipmunk Studio. AI-generated content produced within the App remains the property of the user, in accordance with the terms of the AI service provider used, including but not limited to OpenAI. By using the App, you grant Chipmunk Studio a non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and distribute such content as necessary to provide and improve the App’s functionality, in compliance with applicable laws and the respective AI service provider’s usage policies, including but not limited to OpenAI. However, AI-generated content may be subject to OpenAI’s usage policies, and users should ensure their use of AI-generated outputs complies with OpenAI’s guidelines.

You may not use our branding, logos, or content, including AI-generated outputs, without prior written permission. Additionally, AI-generated content is provided “as is” and should not be relied upon as factual or authoritative. AI-generated outputs should not be used for legal, financial, medical, or other high-risk decision-making purposes. Chipmunk Studio does not guarantee the accuracy, completeness, or reliability of AI-generated content and disclaims all liability for any decisions or actions taken based on such content.

User Conduct

You agree not to:

• Engage in harmful, abusive, or unlawful behavior while using the App.
• Violate any applicable laws or third-party rights.
• Interfere with or disrupt the App’s functionality.

We reserve the right to terminate accounts that violate these Terms.

Limitation of Liability

The App is provided “as is” without warranties of any kind. We are not responsible for:

• Any loss, damage, or data breach resulting from your use of the App.
• AI-generated responses that may be inaccurate or misleading.

Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it.

Updates and Changes

We may update these Terms from time to time. The latest version will always be available in the App. Continued use of the App after changes to the Terms constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the United States and the State of California. Any disputes shall be resolved in the courts of California, unless otherwise required by applicable law.

Indemnification

You agree to indemnify and hold Chipmunk Studio harmless from:

• Any claims, damages, or liabilities arising from your use of the App.
• Violations of these Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
